1. General Information
- 1.1 Purpose
- This privacy policy has been prepared by OPGG Inc. ("we", "us", or "our") to regulate various matters related to the collection of personal information from Gigs users and the use of such personal information in relation to the provision of an online platform service called "Gigs" that mediates the sale and purchase of lecture services through the website https://gigs.op.gg/ (opens in a new tab) ("the Site") or PC and mobile applications developed by us ("Apps").
- 1.2 Disclosure of this Privacy Policy
- This Privacy Policy is announced as an item called "Privacy Policy" at the bottom of the initial screen of the Site or Apps.
- 1.3. Amendments to this Privacy Policy
- We are free to amend this Privacy Policy, provided that such amendments do not violate applicable law.
- 1.4. Target of Application
- This Privacy Policy applies to Gigs users who have obtained approval from us by applying for Gigs utilization while being registered as members ("OPGG members") on the information and communication network (https://www.op.gg/ (opens in a new tab)) currently operated by us.
- 1.5. Effect of Revised Privacy Policy
- 1.5.1. We shall start at least 7 days prior to the effective date of the revised Privacy Policy (at least 30 days prior to revisions to disadvantageous content to Gigs users or important parts of this Privacy Policy), or the initial screen of the Site or Apps. On the connection screen of the above, the revised Privacy Policy is announced by specifying ① the effective date, ② the details of the revision, and ③ the reason for the revision.
- 1.5.2. The revised Privacy Policy shall be effective from 0:00 on the effective date.
- 1.5.3. The act of Gigs users using Gigs after the effective date of the revised Privacy Policy is considered to have expressed their intention to agree to the revised Privacy Policy.
- 1.5.4. Gigs users must not use Gigs if they do not agree to the revised Privacy Policy.
- 1.6. Gigs users have the right to withdraw their consent for the provided personal information at any time. However, if Gigs users choose to withdraw their consent for the provision of personal information to us, they may be subject to limitations, including the inability to use Gigs.
- 1.7. This Privacy Policy applies only to Gigs users who reside within the United States.
2. Regarding individuals under the age of 14 (minors)
- 2.1. Individuals under the age of 14 are not allowed to use Gigs.
- 2.2. We do not intentionally collect personal information from individuals under the age of 14 or individuals who are legally prohibited from using Gigs.
- 2.3. If we become aware that we have collected personal information of individuals under the age of 14, unless required by law, we will immediately dispose of such information.
- 2.4. If Gigs users believe that we have unintentionally collected personal information from individuals under the age of 14, please contact us immediately.
3. Purposes of Personal Information Processing and Details of Collected Personal Information
- 3.1. We collect a minimum amount of personal information from Gigs users and use the collected personal information only within the scope previously notified, without exceeding the notified purposes and scope or providing it to third parties without prior consent. However, in accordance with the procedures and methods prescribed by applicable laws, we may provide the personal information of Gigs users to courts, investigative agencies, or administrative agencies upon their request without the prior consent of the respective Gigs users.

- 3.5. We may additionally collect personal information of Gigs users in the process of applying for events and prizes other than the Service(= qeeq) provided to the Gigs users. In this case, we shall separately notify and obtain separate consent from the Gigs users at the time of collection regarding the items of personal information to be collected, the purpose of collection and use, and the storage period.
- 3.6. We are not obligated or responsible for any tax issues that Gigs users residing in the United States need to report to the United States. However, if Gigs users residing in the United States are required by South Korean law to report taxes to South Korea, we may collect necessary personal information for tax reporting from those Gigs users in accordance with the provisions of that law.
- 3.7. We will dispose of the personal information of Gigs users collected for the purpose of filing tax declarations in South Korea after achieving the intended objective of providing such data. However, we may retain personal information for the period prescribed by the laws of South Korea.
4. Gigs Users' Obligations in Personal Information Management
- 4.1. Gigs users are responsible for protecting their personal information, especially their ID and password, which are authentication credentials for using Gigs.
- 4.2. Gigs users must maintain the security of their ID and password, which serve as authentication credentials for using Gigs, and must not transfer, lend, or allow third parties to use the aforementioned ID and password.
- 4.3. Gigs users are responsible for keeping their provided personal information up to date, and any issues arising from providing inaccurate information are the responsibility of the respective Gigs users.
- 4.4. Gigs users are solely responsible for any consequences resulting from their failure to log out (disconnect) after using Gigs.
5. Installation/operation and rejection of automatic personal information collection devices
- 5.1. Cookies are small amount of data stored on the information and communication devices used by Gigs users
- 5.2. We use cookies to analyze the frequency of Gigs users' connections, visitation times, website usage history, and participation levels in various events. This analysis helps to understand the usage patterns and areas of interest of Gigs users. With this information, we can provide optimized information or advertisements to Gigs users and offer personalized services tailored to individual preferences.
- 5.3. Gigs users have the option to allow or reject the "cookies" automatically collected by us. However, if Gigs users refuse the installation of cookies, they may experience difficulties in using Gigs provided by us.
- 5.4. The following are the methods to refuse cookies storage

- 5.5. In order to provide Gigs users with more suitable and useful services, we analyze the "Gigs usage records" through Google Analytics, a web analytics tool provided by Google. In this case, we utilize de-identified information that cannot identify specific Gigs users. However, despite this, Gigs users can still refuse the use of Google Analytics by installing additional functionality (https://tools.google.com/dlpage/gaoptout (opens in a new tab)).
- 5.6. We and our third-party service providers use cookies and other tracking mechani sms to track information about Gigs users' Site and Apps usage. We may combine this personal information with other personal information collected from the Gigs users (which may be done by third-party service providers on behalf of us). However, while it is possible to disable specific tracking as described in this section (e.g., disabling cookies), such disabling may impair the use of the Site and Apps.
6. Third-Party Disclosure of Personal Information
- 6.1. We use personal information within the scope specified in the "3. Purposes of Personal Information Processing and Details of Collected Personal Information" section of this Privacy Policy and generally does not provide Gigs users' personal information to third parties.
- 6.2. Notwithstanding the above 6.1., in cases such as those listed in Table <2>, we may provide Gigs users' personal information to third parties.

- 6.3. In the event that we are acquired or merged with another company, where substantially all of its assets are transferred to another company, or as part of bankruptcy proceedings, we may transfer the personal information collected from Gigs users to another company.
- 6.4. We may disclose the personal information collected from Gigs users to comply with legal obligations, judicial procedures, court orders, or subpoenas, and other legal processes
- 6.5. We may disclose the personal information collected from Gigs users if it is deemed necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations related to potential threats to personal safety, violations of the Terms of use or this Privacy Policy, or if we use the information as evidence in a lawsuit.
- 6.6. Gigs users have the right to refuse our disclosure of personal information to third parties and may withdraw their consent at any time. However, if Gigs users revoke their consent for the disclosure of personal information provided to us in order to obtain the status of Gigs general user or Gigs expert, they may lose their respective statuses, and as a result, they may face restrictions, such as being unable to access Gigs.
7. Personal Information Processing Outsourcing
- 7.1. We outsource the processing of personal information as shown in Table <3> below to provide better Gigs to Gigs users. We manage and supervise the entrusted processors to ensure compliance with current privacy laws and regulations, including the Personal Information Protection Act.

- 7.2. If the purpose of entrusting personal information provided by us to a subcontractor has been completed, the retention and use period of the personal information provided to the subcontractor will be immediately terminated. However, if there is a continuing need to provide the information due to the nature of the entrusted purpose, the subcontractor will retain and use the personal information received from us until the withdrawal of Gigs users or the termination of the subcontracting agreement with OPGG membership.
- 7.3. As we utilize servers within South Korea provided by Amazon Web Services, Inc., personal information entrusted to Amazon Web Services, Inc. will not be transferred overseas.
8. Do Not Track
- 8.1. We do not respond to "Do Not Track" (DNT) signals. However, some third-party websites may track the browsing activities of Gigs users. When Gigs users visit such websites, they can inform the respective website through their web browser's default settings that they do not wish to be tracked. Gigs users can enable or disable DNT by visiting the default settings or preferences page of their web browser.
9. Third Party Advertising
- 9.1. In order to provide better advertisements for products and services that may be of interest to Gigs users, we may collaborate with third-party advertising companies. These third-party advertisers may use cookies alone or in conjunction with other tracking technologies to collect personal information of Gigs users when they use the Site or Apps. Over time, they may collect personal information about the online activities of these Gigs users across various websites and other online services. They may use this personal information to provide interest-based advertising or other targeted content. The current third-party advertising companies or advertisers that are collecting personal information of Gigs users are as follows, and Gigs users have the right to stop or raise objections to such processing. However, the third-party advertising companies or advertisers may change periodically.
- 9.2. These online advertising partners cannot access or use the nicknames, phone numbers, or other personal identifying information of Gigs users without their consent. However, they may anonymously track the internet usage of these Gigs users on other websites outside of these sites using persistent identifiers. We restrict the additional use of such personal information, but such third parties may be able to personally identify these Gigs users using sufficient personal information from other sources.
- 9.3. Third-party advertising providers and other non-affiliated advertisers also display advertisements on our Site or Apps. As part of the service, they may place separate cookies on Gigs users' computers or utilize other data collection and tracking technologies to gather data such as IP addresses, browser types, servers logged into by Gigs users' computers, geographical areas associated with Gigs users, and whether they have responded to specific advertisements. - 9.4. We do not control the tracking technologies, methods, or information that can be collected by these third parties, nor does it assume responsibility for the privacy policies or content of these third parties. We may occasionally add or modify the list of third-party ad servers, and it is recommended to check for any changes in this section. 10. International Information Transfers
- 10.1. The Site or Apps are operated in South Korea. If Gigs users choose to provide their personal information to us, their personal information will be transmitted, processed, and stored in South Korea. By using the site or Apps after agreeing to the terms of this Privacy Policy, it indicates the consent of Gigs users to such practices and the transfer of personal information to South Korea. Additionally, as described above, employees, contractors, and affiliated organizations that process personal information on behalf of us may be located in countries other than South Korea or the home country of those Gigs users.
- 10.2. By using the Site or Apps, Gigs users consent to the international transfer of personal information collected by us from them.
11. Retention period and deletion of personal information
- 11.1. We retain the personal information of Gigs users entered on the Site or Apps only for the duration necessary to operate Gigs.
- 11.2. If Gigs users do not use Gigs for more than 1 year from the last time they accessed the Site or Apps, the personal information of the respective Gigs users will be deleted at the point when that 1-year period has elapsed.
- 11.3. Even if the personal information has elapsed one year since the Gigs user's last access to the Site or Apps, we may retain such personal information for legal compliance, fraud prevention, dispute resolution, problem-solving, supporting any investigation, and other actions permitted by law.
- 11.4. Personal information stored in physical form will be shredded or incinerated, and electronically stored personal information will be deleted using commercially reasonable technical measures that prevent the reproduction of records.
12. Security
We have implemented appropriate security measures, including encryption and anonymization, to prevent accidental disclosure, unauthorized access, alteration, or disclosure of personal information of Gigs users. Access to Gigs users' personal information is restricted to employees, agents, and representatives who need access to it for business purposes. They are required to process Gigs users' personal information only in accordance with our instructions and are bound by confidentiality obligations. We have established safety procedures to handle suspected personal information security breaches and will notify the affected members and relevant regulatory authorities in cases where required by law. However, we do not assume responsibility for issues that may arise due to Gigs users' negligence, internet-related problems, or other factors beyond the implemented security measures and procedures. It is important to note that transmitting personal information over the internet is not 100% secure, and therefore, we cannot guarantee the complete security of all collected and used personal information.
13. Privacy Rights of Gigs Users
- 13.1. Gigs users have the right, in accordance with applicable laws, to oppose, request limitations on, access, modify, delete, transfer, and make similar requests regarding the processing of their personal information by us.
- 13.2. We will respond to all requests from Gigs users who wish to exercise their privacy rights in accordance with applicable laws. These rights include, but are not limited to:
- (1) Gigs users have the right to know how we process their personal information and the scope of such processing.
- (2) Gigs users have the right to access the personal information processed by us regarding them.
- (3) Gigs users have the right to correct inaccurate personal information concerning themselves and complete incomplete personal information considering the purpose of processing.
- (4) Gigs users have the right to request the deletion of their personal information from us when there is no legitimate reason for us to retain such information.
- (5) Gigs users have the right to restrict the processing of their personal information by us when there is no legitimate reason for us to continue processing their personal information.
- (6) Gigs users have the right to receive the personal information they have provided to us in a commonly used and machine-readable format (data portability).
- (7) Gigs users have the right to object to the processing of their personal information by us based on specific circumstances related to themselves.
- (8) Gigs users have the right to withdraw their previously given consent at any time.
- (9) In order to protect the privacy of Gigs users, we may request proof of identity before collecting their personal information. We may be required to retain certain personal information for legal and/or legitimate business purposes.
- 13.3. Gigs users can generally access, update, change, or delete user profile and account data by logging into their account and managing their profile settings.
14. Objection to personal information processing for us
If Gigs users believe that we have not complied with this Privacy Policy in any way, they have the right to raise objections to us, and in such cases, we will make its best efforts to address the concerns of those Gigs users.

Links to Other Websites From time to time, we may provide links to other websites for the convenience and information of Gigs users. These websites operate independently of our Site or Apps and are not under the control of us. These websites may have their own privacy policy or terms of use, so it is strongly recommended to review them when visiting linked websites. 17. Notice of Privacy Rights to California Residents
- 17.1. In accordance with the California Privacy Rights Act ("CPRA"), we provide this notice of privacy rights to California residents. Unless otherwise specified, all terms used in this notice have the same meanings as defined in this Privacy Policy. Therefore, this notice, together with the Privacy Policy, constitutes the privacy policy for California residents.

- 17.5. Disclosing Personal Information
- 17.5.1. We may disclose certain personal information to third parties for the provision and improvement of Gigs, among other purposes. When disclosing personal information for such purposes, we enter into contracts that explain the purpose and require the recipient to maintain the confidentiality of the personal information and not use it for purposes other than contract performance.
- 17.5.2. During the past 12 months, we have not disclosed personal information collected, except to the third parties listed in 17.5.3. Additionally, we have not sold or shared personal information during the same period.

- 17.6. Our Privacy Policy Towards Children
- 17.6.1. We do not directly collect personal information from minors. If Gigs users are under 16 years of age, they must not provide personal information to us through the Site or Apps.
- 17.6.2. If it is discovered that we have directly collected personal information from a minor under the age of 16, we will immediately delete that personal information. For additional information regarding privacy rights for Gigs users who are California residents, please follow the guidelines listed in 17.7 below.
